Transfer of non-residential real estate is conducted through the State Registration Chamber.

The Administrative Regulation for providing state services related to the drafting of contracts for the transfer of non-residential real estate to another party and the state registration of rights to such property has been approved.

A resolution was adopted by the Cabinet of Ministers on November 29, 2024, No. 795 "On the approval of the Administrative Regulation for providing a composite state service for the execution of contracts for the transfer of non-residential real estate to another party and the state registration of rights to it."

 

The regulation applies to all instances of transferring non-residential real estate between legal entities, excluding donation and lease agreements.

 

At the same time, the regulation does not prevent the parties from independently executing contracts or notarizing these transactions.

 

The contract execution is carried out in the following order:

  • applicants (representatives of legal entities) personally visit the Central State Office (CSO) with their request;
  • the CSO verifies the identities of the applicants within 20 minutes, confirms the fact of personal signing of the contract, and sends the contract to the Chamber of State Cadastres;
  • the Chamber of State Cadastres sends a certificate from the state register to the CSO after registering the rights;
  • the CSO sends the certificate to the applicants' email address within 10 minutes after receiving it and notifies them of this (upon request, the certificate can be issued in paper form).

 

A fee of 2 BRW is charged for executing contracts through the CSO.

 

The document has been published in the National Database of Legislation and came into effect on December 3, 2024.
