How are court decisions from foreign countries enforced?

The Criminal Procedure Code has been updated with a new chapter.

The President has signed the Law dated December 4, 2024, No. ZRU-1009 "On Amendments and Additions to the Criminal Procedure Code of the Republic of Uzbekistan".

Criminal Procedure Code is supplemented by Chapter 66, which regulates the procedure for:

  • recognizing and enforcing a judgment from a foreign court;
  • accepting and transferring a person to a foreign state:
    • convicted to imprisonment, for further serving their sentence;
    • subject to a compulsory medical measure, for continued mandatory treatment.

In accordance with the procedures established by the CPC and international treaties, a foreign court's decision may be recognized and enforced in Uzbekistan in the following cases:

  • the acceptance of a citizen of Uzbekistan, who is serving a prison sentence in a foreign state, to continue serving their sentence in Uzbekistan;
  • the acceptance of a citizen of Uzbekistan who committed a socially dangerous act in a foreign state while being insane or who developed a mental disorder after committing the act, regarding whom there is a foreign court's decision on the application of a compulsory medical measure, for undergoing mandatory treatment in Uzbekistan;
  • the extradition from a foreign state to Uzbekistan of a person who has been convicted by a foreign court and has not served their sentence;
  • the refusal to extradite a citizen of Uzbekistan who has been convicted by a foreign court;
  • in other cases provided for by international treaties.

The document has been published in the National Database of Legislation and came into force on December 5, 2024.
