A resolution from the Cabinet of Ministers dated 05.12.2024 No. 813 “On the Approval of the Regulation on the Procedure for Remote Monitoring via Electronic Bracelet for Individuals Subject to Preventive Measures in the Form of House Arrest and Sentenced to Restrictions on Freedom” has been adopted.
The regulation governs relationships related to:
- the rights and responsibilities of individuals required to wear an electronic bracelet;
- the liability for violating the terms of wearing the electronic bracelet;
- the procedure for compensation for material damage in case of damage or loss of the electronic bracelet.
The electronic bracelet will be implemented gradually starting from January 1, 2025.
The electronic bracelet is worn on the leg of an individual who is subject to preventive measures in the form of house arrest or who has been sentenced to restrictions on freedom. If wearing the bracelet on the leg is not possible (due to a broken bone, medical treatment for other injuries, etc.), it may be worn on the arm.
The electronic bracelet does not apply to:
- individuals under 18 years old;
- pregnant women;
- women with children under 3 years old;
- individuals with disabilities of the first or second group;
- individuals for whom wearing an electronic bracelet is not recommended for medical reasons (people with implanted pacemakers, skin infections (allergic contact dermatitis, skin fungi or scabies)).
Individuals subject to the electronic bracelet are required to:
- charge the electronic bracelet within the specified time;
- not remove the electronic bracelet without permission;
- not engage in actions that may damage the electronic bracelet.
The document has been published in the National Database of Legislation and came into effect on 05.12.2024.
