In Khorezm, a man who harassed a minor has been sentenced to one day in jail.

Initially, the man was sentenced to 15 days of administrative detention. However, the appellate court took into account his disability and the fact that he has four children, reducing his punishment to just 1 day and imposing a fine instead.

The Khorezm Regional Court for Criminal Cases reviewed the appeal of a 42-year-old man contesting the court's decision in a sexual harassment case.
According to the materials from the first-instance court, citizen O. M., while under the influence of alcohol, committed indecent acts against his 16-year-old neighbor in front of her home. He made various suggestive remarks, attempted to touch her chest, and uttered obscene words towards her. The court sentenced him to 15 days of administrative arrest.
Dissatisfied with the court's ruling, the lawyer stated in his appeal that the first-instance court examined the case in a one-sided manner, failing to investigate all the circumstances comprehensively, and requested a fair decision.
It turned out that the offender is a second-group disabled person. According to part 2 of article 29 of the Administrative Code of Uzbekistan, the measure of administrative arrest cannot be applied to individuals with first or second group disabilities. Under such circumstances, the imposition of administrative arrest on O. M. is deemed unacceptable.
Additionally, the court did not take into account mitigating circumstances such as the absence of prior administrative offenses, family status (four children), and financial condition (temporarily unemployed), and imposed a penalty that was not commensurate with his character.
Based on this, the court rendered a decision to replace the 15 days of administrative arrest with 1 day of detention, as well as impose a fine of 3 BRV (1.25 million sums).
